Terms of Service

Welcome to AM2PM Logistics. These Terms of Service (“Terms”) govern your access to and use of our logistics, transportation, warehousing, and freight-related services (“Services”) provided by AM2PM Logistics (“we,” “our,” or “us”). By using our website, communicating with our team, or engaging any of our Services, you accept and agree to these Terms in full.

If you do not agree with these Terms, please refrain from using our Services.

Scope of Services

AM2PM Logistics offers a wide range of transportation and logistics solutions across North America, including but not limited to Full Truckload (FTL), Less Than Truckload (LTL), Hotshot, Last-Mile, Warehousing, and Temperature-Controlled services.

All services are offered based on availability, capacity, and operational feasibility. AM2PM reserves the right to refuse or cancel services at our sole discretion, particularly if the customer provides incomplete, false, or misleading information

Availability and Operating Hours

Our operations run 24/7, including weekends and holidays. However, availability may vary based on driver schedules, weather conditions, and logistical constraints.

AM2PM Logistics operates as a fully remote and dispatch-based logistics company, with no physical office locations. All communications and transactions are conducted digitally or via phone.

Quotes, Estimates, and Pricing

Quotes provided through our online form, email, or phone are estimates only and based on the shipment details you provide. Final charges may vary based on:

  • Actual shipment weight and dimensions
  • Route or mileage changes
  • Fuel surcharges or tolls
  • Delivery access issues or special handling
  • Delays due to unforeseen circumstances

 

Customers are responsible for ensuring that all shipment details are accurate and up to date. We reserve the right to revise rates if the final shipment deviates from the original information.

Cargo Liability & Insurance

Unless otherwise agreed in writing, AM2PM Logistics limits its cargo liability to CAD $2.00 per pound.

This limit applies to damage, loss, or delay of cargo while under our control or the control of any third-party carrier we may engage.

Customers shipping high-value or sensitive goods are strongly advised to declare their value in advance and arrange for additional insurance coverage. AM2PM will not be responsible for claims exceeding our standard liability limits unless expressly agreed to in writing.

Customer Responsibilities

Customers must:

  • Provide accurate and complete shipment details
  • Ensure freight is packaged securely and labeled correctly
  • Ensure the pickup and delivery locations are accessible
  • Be available or have a designated representative available at the time of pickup and delivery
  • Notify AM2PM of any special handling requirements in advance

 

We are not liable for delays or damages caused by improper packaging, restricted access, loading dock issues, or inaccurate information.

Third-Party Carriers & Subcontractors

To provide the most efficient service possible, AM2PM Logistics may utilize third-party carriers, drivers, or warehouse partners. While we take care in selecting trusted providers, we do not control third-party operations and are not responsible for delays, damages, or service issues caused by external parties.

Engagement with AM2PM implies acceptance of these third-party partnerships as part of our service model.

Limitations of Liability

To the fullest extent permitted by law, AM2PM Logistics disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted service.

Under no circumstances shall AM2PM Logistics be liable for:

  • Indirect or consequential damages
  • Loss of revenue or business opportunity
  • Delays due to weather, strikes, accidents, natural disasters, or governmental actions
  • Any losses resulting from services rendered by third-party contractors

 

Total liability, if any, shall not exceed the amount paid for the specific service in question or CAD $2.00 per pound of lost or damaged cargo, whichever is less.

Force Majeure

AM2PM Logistics shall not be held liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to:

  • Natural disasters (storms, floods, earthquakes)
  • Acts of God
  • Pandemics or health emergencies
  • Labor strikes or shortages
  • Border delays or customs issues
  • Fuel shortages or equipment failures

 

Such events shall suspend our obligations under these Terms for the duration of the disruption.

Indemnification

You agree to indemnify, defend, and hold harmless AM2PM Logistics, its affiliates, officers, agents, employees, and subcontractors from any claims, liabilities, damages, costs, or expenses—including legal fees—arising out of your use of our services, your breach of these Terms, or any inaccurate information provided by you.

Dispute Resolution

Any disputes arising from the use of AM2PM Logistics’ services shall be resolved under the laws of the Province of Ontario, Canada. Disputes shall be subject to binding arbitration or small claims court as applicable. Class actions and jury trials are explicitly waived.
